Implementation of the concept of essentially derived variety
In article 14.5(i) of the 1991 UPOV Convention Act 1 , the scope of the rights of a breeder of a protected plant variety were extended to include essentially derived varieties. Implementation of this concept is being discussed at the present by the professionals with respect to a number of plant species, notably maize and lettuce. In this connection Limagrain would like to express its convictions concerning the conditions of this implementation.
